if an item/ product is not on the ML list, but the end use is military it is not to be exported under an OGEL? – No Licence or a SIEL?

If your product is not listed on the UKML, then being used for a military purpose does not necessarily make it a controlled item – a fountain pen being used on a military base for example.
The issue in this case would be related more to sanction/embargo issues or the actual end user.
