What responsibilities do we have if employing an agent in the USA?

Question

What responsibilities do we have if employing an agent in the USA?

Answer

The law in the US is a completely different ballgame when compared to the UK and EU. As a result, it is important to make sure that you instruct local legal experts to navigate this issue. Working on the premise that this is identical or analogous to the laws of England and Wales might throw up a few inconvenient surprises. As with all agency arrangements it’s important to make sure that you have a written contract in place to ensure that your agent is working with your best interests in mind. The further away your agents are, the less immediate control you have over them unless you have an agreement in place.
