UK Export controls – What are the similarities/differences to US regs?

Question

What are the similarities/differences to US regs?

How must US-owned foreign subsidiaries follow regs, re export rules?

(This question was asked at one of our recent webinars on Export Controls. You can listen to this webinar on our recent webinars page at https://opentoexport.com/info/webinars/)

Answer

Despite being a subsidiary of the US company, the U.K. Regulations are your priority when looking to export from the UK.

Yes there is the possibility that you are manufacturing items using US origin technical data which would then be controlled under the US regs, and you would need to abide by the regulations for any US origin hardware that you have received and are looking to re-export, but if you are manufacturing UK designed and manufactured products the US regulations are irrelevant.

You will be subject to the jurisdiction of the FCPA (Foreign and Corrupt Practices Act) in addition to the UK Bribery Act though so that is something else to consider.
