Export Controls: Is a site visit proof enough for export controls dual use purposes?

If we have visited the site of our customers and are therefore 100% certain they have nothing to do with the military or any human rights abusers and are in the food industry, do we need to worry about control lists for dual purpose use items?

Answer

You will need to check any item you are exporting is not on the Strategic Export Control List. Some products used in the food industry, such as freeze dryers, fermenters and other similar equipment may be controlled under entry 2B350. While the majority of food processing equipment is not subject to export control, you do need to make sure that any equipment, or spares, you supply is not specifically listed. If your items are not listed, you will still need to consider the End Use Controls.
