Question posted by Daniel Heymans, on behalf of ITE (UK) Ltd in RG19

A potential customer in Brazil claims that when importing goods, the supplier must inform him of the identity (name and address) of the manufacturer. Is this true?

Your potential customer is correct. Bringing goods into Brazil will require a Certificate of Origin and the invoice paperwork will have the address details of the supplier as well. It sounds like you have some (valid) concerns that your potential customer is seeking information to buy direct from your supplier possibly at a later stage. Hard to avoid in any set of circumstances unless you are able to open up this info to them, safe in the knowledge your supplier will not entertain them. Worth thinking through beforehand.

Hi Daniel,

If you are shipping the goods direct from the manufacturer then it might be rather difficult to avoid giving your customer the Manufacturer's details. However, if you are shipping the goods from your own premises, then the paperwork will have your details.

Whether your Customer has to, under Brazilian law, supply their authorities with additional information relating to the Manufacturer, is often determined by the products/services being shipped. However, these do tend to be items which are already regulated (requiring an export licence) or, for example, some types of medical products.

Is your potential customer in Brazil asking you to provide the Manufacturer's details even when you are shipping the goods from your own premises? If so, then you might politely ask them to provide you with the relevant bit of Brazilian legislation which requires you to supply them with this information. If this is forthcoming, then at least you will have additional information with which to make a commercial decision.
